Man shot by deputy recovering after surgery

GAINESVILLE - A 50 year old Barrow County man was in serious condition Tuesday morning after undergoing surgery after being shot Monday by a Hall County deputy sheriff.

Jesse Byron of Auburn was shot after attempting to strike the deputy with an aluminum baseball bat, according to sheriff's office spokesman Jeff Strickland. The shooting occurred at Countryside Village Mobile Home Park near Flowery Branch following a lengthy foot chase that followed a traffic stop on Carter Road.

Strickland said the preliminary investigation indicates the officer acted within Sheriff's Office policy and was justified in the use of force. The Sheriff's Office has requested the Georgia Bureau of Investigation to conduct an independent investigation of the incident and the deputy has been place on administrative leave pending the review of the incident.

Byron has been charged with Aggravated Assault on a Police Officer (2 Counts), Obstruction of an Officer, Habitual Violator, and a Probation Warrant.
