'Industrialized' housing issue headed back to city planners

GAINESVILLE - A developer who has been locked in a legal dispute with the City of Gainesville over construction of an "industrialized" house in Waters Edge Subdivision will be back before city planners next week.

Grant Smereczynsky wants the city to rezone the disputed property from R-I to R-II.

The planning staff recommends denial, saying Smereczynsky is merely trying to circumvent the city's regulations calling for "stick-built" houses only in Waters Edge. The staff's report says there's another factor, as well. "While the proposed industrialized home is a single-family use, the application for rezoning the property to R-II is not consistent with the rezonings of the adjacent properties and is not compatible with the zoning of the entire neighborhood," it reads.

The lot in question contains a partially-constructed industrialized house. The city ordered that work on the house stopped last year because officials say such structures are not permitted in areas zoned R-I.

Smereczynsky took the city to court, but lost one round in Hall County Superior Court a few months ago. However, Smereczynsky vowed at that time to keep fighting because, he claims, the state Department of Community Affairs is on his side.
