<p>A Cobb County judge has been arrested and charged with drunken driving, and the former state legislator has issued a statement saying he takes full responsibility for his actions.</p><p>Superior Court Judge Ken Nix, 65, was stopped Friday after a Lawrenceville officer noticed Nix's Pontiac Montana swerving on state Highway 316, said Lawrenceville police spokesman Greg Vaughn.</p><p>Nix consented to a Breathalyzer test, which determined he had a blood-alcohol content of .104, Vaughn said. The legal limit is 0.08.</p><p>Nix was released from the Gwinnett County Detention Center without paying a bond after promising to appear in court, said sheriff's spokeswoman Stacey Kelley.</p><p>The judge said in a statement that he regretted the incident.</p><p>"Earlier in the week, I had some medical procedures performed and had not eaten well for several days. I exercised poor judgment on this occasion," Nix said in the statement. "Nothing like this has ever happened to me before. I assure my family, my friends and the citizens of this state that it will never happen again."</p><p>Nix was charged with driving under the influence and failure to maintain a lane.</p><p>After Nix served 12 years as a state court judge, then-Gov. Zell Miller appointed him to the Cobb County Superior Court in 1995, according to the superior court's Web site.</p><p>He was a member of the Georgia House of Representatives from 1973-1982.</p><p>___</p><p>HASH(0x2866598)</p>
