Tim Venable, chairman of the citizens group that filed the suit, says the hearing will be held Tuesday afternoon.
The suit, which was filed several weeks ago, alleges that the commission would be violating the state constitution by incurring a $22 million debt to finance the construction.
But, attorneys for the county contend the financing mechanism proposed by the county is legal based on a ruling in a 13-year-old case originating in Rome.
