LAFAYETTE - A hearing is scheduled Friday on whether Walker County grand jurors should be disqualified from hearing evidence against Tri-State Crematory operator Brent Marsh.

Marsh's attorney, Ken Poston, said the order that creates the current grand jury was signed by Judge Jon Wood, who earlier disqualified himself from the case.

Citing personal ties to the case, Wood and three other judges in the Lookout Mountain Judicial Circuit disqualified themselves in March.

Marsh faces nearly 400 felony charges relating to the recovery of more than 340 uncremated bodies from the Walker County crematory in February of last year.

Poston also will ask that Marsh be removed from an electronic monitoring program and be allowed to travel more than 50 miles from his home, if accompanied by an attorney.

Judge James Bodiford of Cobb County Superior Court, appointed to hear the case, will rule on the motions.
