MARIETTA - Two adult night clubs will challenge the city of Marietta's claim in court next week that they can't sell sex toys and X-rated films.
Boomers and Cyprus Lounge were temporarily forced to close their adult novelty businesses this week. Both establishments quickly reopened because they contend the sale of adult novelties is legal under city code.
City Attorney Doug Haynie says if they remain open the city will take them to court next week.
In Marietta, it isn't illegal to sell sexually explicit items but several criteria must be met for a license to be approved. The business can't be within one thousand feet of a library, church or school; and the novelty items can only make up 20 percent of the items for sale.
