Florida cemetery sued for alleged contract breach

JACKSONVILLE, FLORIDA - A man who says his grandmother was buried in a mausoleum in Florida without his request is suing the cemetery for breach of contract and fraud. <br> <br> Tracy Alexander of Savannah says he paid Marion Graham Mortuary $4,000 for Theresa Jones&#39; 1998 funeral and ground burial in Restlawn Memorial Park. <br> <br> He says that Jones&#39; service was conducted in front of an open grave. Alexander also believed Jones had been buried in the ground after the service. <br> <br> Two years later, he returned to the same cemetery to bury his aunt and found his grandmother interred in a crypt he never ordered. <br> <br> Alexander is seeking more than $15,000 from the mortuary and Restlawn for expenses, mental pain and suffering, and other compensatory damages. <br> <br> Restlawn Assistant General Manager Pete Dunmyer says the cemetery never dealt with Alexander and is not responsible. <br> <br> Records show Restlawn has an unsatisfactory record with the Better Business Bureau of Northeast Florida because of its history of not responding to consumer complaints.
