HUNTINGTON, WEST VIRGINIA - The charge against a Marshall University basketball player accused of attacking a Huntington police officer has been dropped.

Twenty-two-year-old senior guard Richard Wilson of Augusta had been charged with battery against a police officer.

Cabell County Magistrate Johnny McCallister dismissed the charge Monday because of failure to prosecute. The move came after the police officer failed to appear in court, according to McCallister's clerk.

The case stemmed from an early morning fight at a bar near the Marshall campus on June 14. According to court records, Wilson suffered minor facial injuries.

When an officer tried to gather information about the fight, Wilson allegedly punched him in the left shoulder and neck area.

The officer then pepper-sprayed Wilson and restrained him.

If convicted, Wilson could have faced up to a year in jail and a maximum one-thousand dollar fine.
