Jury convicts man in ax murder of couple

JONESBORO - A 38-year-old man was convicted Friday of the ax murder of an Ellenwood couple two years ago. <br> <br> Richard Sealey could get the death penalty in the slaying of retired school custodian Johnny Tubner and Fannie Mae Tubner, who were bound with duct tape and chopped to death in their home. <br> <br> Prosecutors said Sealey wielded the long-handled ax during a night of robbery, torture and murder that involved three younger defendants - including the victims&#39; granddaughter, who was 15 at the time. <br> <br> Defense attorney John Beall told the jury that co-defendants Wajaka ``Tony&#39;&#39; Battiste, 25, of Stone Mountain and Gregory Fahie, 26, of Atlanta probably entered the house without Sealey and killed the couple. <br> <br> The jury is scheduled to reconvene on Monday to decide whether to sentence Sealey to death. <br> <br> During his testimony, Fahie said he was in the house at the time. He said 15-year-old Deandrea Carter told Sealey that he had to kill her grandparents and brought him the ax. He said Battiste remained in the car.
