Police Chief Randall Moon says that the charges stemming from the collision that derailed 13 rail cars and for the evacuation of 200 people are DUI, reckless driving and failure to maintain lane.
If convicted of all charges the maximum penalty would be a fine of $5,000 in lieu of 1 year in jail, plus community service.
Norfolk Southern, the company that owned the train says the accident destroyed 13 cars, 900 feet of track and a railroad crossing.
Clean up and repair is ongoing.
