Condemned killer gets new hearing on death sentence

ATLANTA - Condemned killer Timothy Don Carr, who had been scheduled to die Friday for slitting a teenager's throat in 1994, will have a federal court hearing on the appeal of his death sentence. <br>

The 11th U.S. Circuit Court of Appeals reversed course Thursday and granted Carr a hearing. Last month, the 11th Circuit had refused to hear any issue of Carr's appeal. <br>
<br>
Carr was convicted of killing 17-year-old Keith Patrick Young while in a hallucinogenic haze. The appeals court issued a stay of execution on Tuesday. <br>
<br>
The judges said they would consider three of Carr's claims: <br>

That prosecutors failed to disclose deals with others involved in the killing who later testified against Carr. <br>
<br>
That prosecutors made improper statements to jurors during closing arguments. <br>
<br>
That Carr's trial lawyers did not adequately prepare for Carr's sentencing hearing. <br>
<br>
Brian Kammer, a lawyer for Carr, declined to comment on the court's new order. Russ Willard, spokesman for state Attorney General Thurbert Baker, said his office will continue to defend the conviction.
