Blagg won't fight extradition from Georgia

DENVER, COLORADO - A man arrested in Georgia in the killing of his wife after her body was found in a Colorado landfill has decided to give up his fight against extradition. <br> <br> Michael Blagg, 39, decided Friday night to waive his right to contest extradition, Stephan Schweissing, his lawyer, said Saturday. Blagg had previously said he would fight extradition while weighing his options. <br> <br> ``It wasn&#39;t our intent to drag the process out. It was just simply that we were not going to be rushed into a decision,&#39;&#39; Schweissing said. ``He is comfortable with this decision. It&#39;s his decision to make.&#39;&#39; <br> <br> Schweissing said Blagg could be back in Colorado as early as next week, though it will depend on travel logistics and on how quickly the legal process moves. <br> <br> Blagg was arrested Wednesday at his mother&#39;s house in Warner Robins, Ga., and was being held on $1 million bail for investigation of the murder of his wife. <br> <br> Jennifer Blagg, 34, and the couple&#39;s 6-year-old daughter, Abby, disappeared Nov. 13 from their home in Grand Junction. Michael Blagg told authorities he returned home from work to find a pool of blood in the master bedroom and his wife and daughter gone. <br> <br> The woman&#39;s remains were found in a landfill near Grand Junction Tuesday and Wednesday. Police said she had been shot to death. <br> <br> Investigators continued their search of the landfill for signs of the girl. It ended at about 2 p.m. Friday without turning up any leads, Mesa County sheriff&#39;s spokeswoman Janet Prell said. The search was to resume Monday. <br> <br> Authorities have said it could take weeks to finish sorting through the 7,000 tons of trash in the search area at the landfill. <br> <br> Meanwhile, Schweissing said Blagg will likely make a court appearance early next week in Georgia to tell a judge that he is waiving his right to contest extradition. <br> <br> After that, authorities will take him back to Colorado and he will likely face an advisement hearing before a judge in Mesa County. <br> <br> District Attorney Frank Daniels said Friday prosecutors would not seek the death penalty against Blagg under the murder charge he faces. ``However, should we file a charge for death of Abby Blagg, that situation would change,&#39;&#39; because the second charge could make him subject to the death penalty, he said.
