Man mistaken for `Most Wanted' sues Cobb County police

ATLANTA - A man whose home was raided by a SWAT team after his landlord mistakenly identified him as a fugitive profiled on ``America's Most Wanted'' has filed a $1 million lawsuit against the Cobb County police. <br>

John Bailey, 41, of Vinings claims his life was jeopardized because police failed to fully investigate the tip stemming from the Sept. 1 broadcast. <br>
<br>
The seven-count lawsuit, filed May 23 in U.S. District Court, seeks damages for physical and emotional harm Bailey says he endured because of a 3 a.m. raid in which an officer accidentally shot a bullet into his apartment bathroom. <br>

A police report after the raid asserted that no one was in danger when the shot went off. <br>
<br>
Associate County Attorney Bill Rowling said Cobb officials would respond to the suit in a timely fashion. <br>
<br>
Bailey's lawyer, Steven Berne of Atlanta, said the raid could have been avoided if police had checked Bailey's rental application listing his father as a reference. The fugitive profiled allegedly had killed his father in Missouri.
