LOGANVILLE - Danny Byrd, in jail but still a member of the Loganville City Council, was removed from office during a hearing that was brief and without discussion.

The council voted 3-2 Tuesday on each of the three articles of impeachment against Byrd, who was in court to hear the decision.

The hearing concluded with Byrd's attorney notifying the court he would appeal the decision

Mayor Mike Jones said an appeal likely will let Byrd retain his seat on the council until all his appeals are exhausted.

Byrd has been in the Walton County jail since May 13, serving a 60-day sentence for simple battery, criminal trespass, public drunkenness and harassing phone calls.

Loganville resident Mindy Bass asked the council to remove Byrd based on his guilty pleas to numerous offenses, his prior marijuana and cocaine possession charges and violations of the city charter and ethics ordinance.

The articles of impeachment charged Byrd with malfeasance of office.
