Supreme Court orders retrials over failure to establish venues

ATLANTA - The state Supreme Court has ordered retrials in two murder cases because prosecutors did not establish the locations of the crimes. <br>

The Georgia Constitution requires that the venues in criminal cases must be made clear to a judge or jury. <br>
<br>
Justices agreed today that Clarence Lynn should be retried in the shooting death of 23-year-old Eric Clay, and that Thomas Graham be retried in the death of Alfred Smith. <br>
<br>
In both cases, justices admonished prosecutors for not making sure the venue was clear. <br>
<br>
Lynn was convicted of murder on November 26, 1998. He was convicted in Fulton County of killing Clay on August 24, 1995 with a .45 caliber handgun. <br>
<br>
Graham was convicted of Smith's murder on July 24, 2000. <br>
<br>
Barbara Latimer Jennings, a spokeswoman for the Georgia Supreme Court, says the men will remain in prison until a new trial can be set.
