ATLANTA - Tri-State Crematory operator Ray Brent Marsh lost his bid to get a new judge Wednesday.

The Georgia Court of Appeals in Atlanta denied a motion by Marsh's attorney to remove Superior Court Judge James Bodiford, a Cobb County judge who stepped in substitute for local judges with conflicts of interest.

Bodiford is scheduled to preside over a new bond hearing for Marsh.

Marsh is in the Walker County jail, charged with 266 counts of theft by deception -- taking money for performing cremations and not performing the task.

A total of 339 bodies were found discarded at the northwest Georgia crematory in February.

Marsh attorney Ken Poston can now file a motion for reconsideration to the Court of Appeals, file an application for a hearing before the state Supreme Court, or simply allow the trial to proceed.
