AUSTELL - A Vietnam Veteran's widow filed a $1 million lawsuit against an Austell cremation service Tuesday. She accused the company of contaminating and improperly disposing her husband's remains.
The lawsuit, filed by Mary Ann Robinson, named Professional Cremation Service Inc., according to The Atlanta Journal-Constitution. Owner Van F. Cumbie could not be reached for comment late Tuesday.
Robinson's husband, Patrick, died of lung cancer in Oct. 2000 at 49. In the lawsuit, she said her husband's ashes were returned to the company when a funeral director complained of a noxious smell.
The lawsuit said the company's owner, Cumbie, expressed concern that Robinson's remains hadn't been completely cremated and that decomposing tissue caused an odor in the ashes, according to the newspaper.
The suit also accused Cumbie of disposing part, if not all, of Robinson's remains in the North Georgia mountains and withholding that information from his widow for a year and a half.
