NOBLE - A Cobb County judge was named Monday to preside over the Tri-State Crematory case.
Superior Court Judge James Bodiford was assigned after all four Superior Court judges in the Lookout Mountain Judicial Circuit recused themselves because of ties to people who may have claims against crematory.
Bodiford was assigned by Administrative District Judge Robert James.
Crematory operator Ray Brent Marsh faces 204 charges in Georgia of theft by deception for allegedly dumping bodies on the grounds rather than cremating them, as he was paid to do. The remains of 339 people have been found on the property.
The 28-year-old Marsh also is expected to face similar charges in Tennessee. Records show that at least 250 bodies sent to the crematory since 1998 were from Tennessee.
Marsh has been behind bars since last month.
Marsh's parents and sister also were arrested, each charged with misrepresenting themselves as licensed funeral directors by signing death certificates. They are free on bail.
