'Out of an abundance of caution...' Hall County decides to table nine public hearings

GAINESVILLE – Nine items scheduled to appear before the Hall County Commission for a final decision on Wednesday will be tabled.  That is the decision of the Hall County Commission announced at Monday’s work session.

Included are six rezoning applications and three Special Use applications.

The reason for the mass postponement is errant information on posted notices brought on by two factors: first, renovation work at the Hall County Government Center forced the relocation of commission meetings to the Gainesville Civic Center; second, posted dates for the public hearings that are a required part of the approval process may have added to the confusion.

The information written on mandatory yellow “Zoning Notice” signs, which must be conspicuously posted at each of the sites under consideration, was subsequently changed and that has led to concern and confusion by individuals wanting to make public comment.

Hall County Director of Planning and Development, Sarah McQuade, made the tabling recommendation to commissioners.  “We have identified issues related to the notices posted on the property for all of the zoning public hearings on the board’s agenda for this upcoming Wednesday meeting on November 10th,” McQuade said.

“It would be appropriate for the board to indicate its intent to table the public hearings with regards to these zoning items at the beginning of its meeting on Wednesday.  It would also be appropriate for the board to indicate the time, date and place to which the board intends to table these public hearings concerning these items,” McQuade added.

Hall County Attorney Van Stephens said, “Out of an abundance of caution, and to give the public ample opportunity to speak, we're going to have those set for November 30th.”

Stephens said new “Zoning Notice” signs with updated information will be posted at each of the nine sites and they will be in place in time to satisfy the required fifteen days of notice.

The commissioners agreed and said they plan to table the nine items when they meet Wednesday to a Special Called meeting on Tuesday, November 30, beginning at 5:30 p.m. in the main ball room of the Gainesville Civic Center.

There will not be work session preceding that Special Called voting session.

The nine items to be tabled are:

  • Application of Casey Walker/CSC Properties, LLC, to rezone a 3.63± acre tract located on the north side of McEver Road at its intersection with Lights Ferry Road. Proposed use: gas station & convenience store.
  • Application of Bilal Gillani to rezone a 5.08± acre tract located on the west side of Old Cornelia Highway near the intersection of Shady Valley Road.  Proposed use: auto repair and used auto sales
  • Application of John Roberts to rezone a 38.85± acre tract located on the north side of Lee Land Road at its intersection with Webb Girth Road.  Proposed use: 160 unit townhome development.
  • Application of Atlas Development to rezone a 79.18± acre tract located on the west side of Union Church Road at its intersection with Union Circle.  Proposed use: 148 lot subdivision.
  • Application of Brand Properties, LLC, to rezone a 30.69± acre tract located on the east and west sides of Wallis Road at its intersection with Atlanta Highway.  Proposed use: 298 unit multi-family development.
  • Application of FIDES Development to rezone a 16.28± acre tract located at the terminus of North Waterworks Road.  Proposed use: mixed use residential development.
  • Application of Clyde D. Broadway, Jr. DBA Green Earth Replacement for a Use Subject to County Commission approval on a 12.76± acre tract located on the east side of Calvary Church Road near its intersection with Calvary Industrial Drive.  Proposed use: inert landfill
  • Application of Invest NH, LLC, for a Use Subject to County Commission approval on a 6.75± acre tract located on the east side of Lula Road at its intersection with Glades Farm Road.  Proposed use: 5-lot subdivision.
  • Application of Morteza Modaber for a Use Subject to County Commission approval on a 0.38± acre tract located on the north side of Browns Bridge Road at its intersection with Whiting Drive.  Proposed use: auto repair and body shop.
