GAINESVILLE - A hearing has been scheduled Monday in Hall County Superior Court on the suit filed last month by Eugene Moon, who lost a bid for a seat on the county commission in the July Republican Primary.
Hall County Court Administrator Reggie Forrester said the hearing will be heard by Senior Superior Court Judge Robert W. Adamson of Winder. State law, Forrester said Wednesday, requires that an "outside" judge hear such cases.
Moon, who lost to incumbent Billy Powell for the District 2 seat on the commission, alleges in the suit that the Hall County Elections Board and Hall County Elections Director Charlotte Sosebee failed to use the legally approved district maps for the election, extending District 4 beyond its legal boundaries into District 2 and thereby affecting the race results.
Jeff Stowe won the District 4 race against incumbent Ashley Bell.
In the suit, filed August 10, Moon asks Sosebee to present a map that depicts which voters voted in the election of each post for the Hall County Board of Commissioners, and it also asks the court to render the election invalid.
In addition, the suit contains sworn statements from at least two voters who say they do not reside in District 4 but voted in the District 4 commission race on July 31.
Emory Turner, Rose Johnson and John Varner are also listed as plaintiffs in the suit.
The hearing will be held at 10:00 Monday in Courtroom #1 on the fourth floor of the Hall County Courthouse.
