Counties of House District 28 appeal overturning of election

HOMER – The three counties comprising Georgia House District 28 are joining in the appeal of a senior judge’s ruling that overturned the results of the Dec. 4 election for the seat.

The boards of elections and registration for Banks, Habersham and Stephens counties, like former District 28 Rep. Chris Erwin, are appealing Senior Judge David Sweat’s ruling that threw out the election and removed Erwin from office on Feb. 8.

That appeal is to the Supreme Court, which has jurisdiction over cases of election challenge.

In an election challenge lawsuit filed by Dan Gasaway, who formerly held the seat, Sweat ruled that there were enough improper votes in the December Special Election to place the results of the election in doubt. Thus, he called a new election for April 9.
