CUMMING - Forsyth County authorities said the man shot by a deputy Thursday afternoon is in stable condition at Northeast Georgia Medical Center.

The sheriff's office identified the man as 46-year-old Jeffery Todd Nielson of Cumming.

Deputy Robin Regan said another deputy was patrolling an undeveloped subdivision at Hopewell and Hubbard Town Roads when the incident happened.

"(The deputy) noticed a dark in color pickup truck. When the deputy passed the pickup truck he observed a male inside the pickup truck who was also holding a rifle," Regan said.

Regan said when the deputy approached the truck, the man got out, pointed the rifle at the deputy and moved the rifle's lever action.

That's when the deputy fired, according to Regan.

"The male (Nielson) was taken to Northeast Georgia in Gainesville, and he is expected to survive."

The deputy is on administrative leave while the Georgia Bureau of Investigation looks into the incident.

Authorities have not released the name of the deputy involved.
