Joshua Busby was charged with cruelty to children in the first degree, according to Hall County District Attorney Lee Darragh.
Busby's daughter, Averee, was only seven pounds when she was admitted to Scottish Rite for seizures. Doctors discovered her seizures were caused by several severe skull fractures.
In turn, they discovered the skull fractures were from repeated blunt force trauma.
"The defendant at trial had claimed that his 18 month old son had caused the injuries to the child," Darragh said. "But the examining doctor observed that the force needed to cause the bilateral skull fractures that the child suffered was equivalent to a high velocity car crash or having a heavy, old fashioned tv set fall onto her head."
Darragh said Judge Jason Deal, who presided over the case, applauded the law enforcement and doctors and nurses who worked tirelessly to save Averee's life.
"After announcing his sentence, Judge Deal told Mr. Busby that 'it's a heavy sentence, but what you did to that child was unforgivable,'" Darragh said.
The 18 month old boy is being taken care of by relatives. The mother of the child was sentenced to seven years served for her negligence in the case. She is currently in the Hall County jail.
