Major Jim Fullington had been on paid administrative leave along with the department's former chief, Dennis Dorsey, and a Lt., Frank Farr, since early November when the city launched an investigation into the testing allegations.
"My review of all the information concerning the improper testing procedures led me to the conclusion that Major Fullington acted properly in response to the information he received," Mayor David Maynard said in an email statement.
Maynard said the investigation is closed.
Lt. Rob Curott had served as acting chief during the leave period.
With Fullington at the helm, Maynard said the city will immediately start the process to hire a permanent chief.
"Major Fullington understands the process that the city went through and appreciates the support of the administration. He pledges his full dedication to move the department forward during this interim period," Maynard said.
Dorsey and Farr tendered their resignations last Tuesday according to city administrator Donald Toms.
Two other officers, Joey Lovinggood and Sgt. Randy Michael, were terminated Friday for not meeting essential duties of the job according to Toms.
