Hall County authorities misidentify suspect as twin brother

GAINESVILLE - Hall County authorities said in a press statement Friday morning that a man arrested in a September altercation with sheriff's deputies was misidentified as his twin brother.

The man arrested at the scene on Bill's Circle in north Hall County was not Keary Maurice Nicely, but was Kelly Martinez Nicely. At the time of the September 25 incident, authorities said they believed Kelly Nicely was under the influence of some type of drug, which lead him to behave irrationally. He was naked at the time of his arrest on the shores of Lake Lanier

The Sheriff's Office said the error occurred because of discrepancies between information developed at the scene of the incident and information that already existed in the Hall County Comprehensive Justice Information System (CJIS).

The statement further noted that booking photo that ran with the original press release was actually a 2011 booking photo of Keary Nicely that already existed in CJIS. The Sheriff's Office said it is not an uncommon practice to use a previous booking photo if a current photo is unavailable. In the case of Kelly Nicely, he was hospitalized immediately following the incident, so authorities said there was not a new photo available.

The Sheriff's Office said it has issued an apology to Keary Nicely for the mix-up.
