Woman sentenced for withholding HIV status from husband

GAINESVILLE - An HIV positive woman from Hall County was sentenced to two years behind bars Saturday after she neglected to tell her now ex-husband she was HIV positive.

Heather Nicole Nix, 36, of Gainesville, was sentenced to ten years with two behind bars and the rest on probation for reckless conduct by an HIV infected person, according to Hall County District Attorney Lee Darragh.

Darragh said in a press release that Nix learned she was HIV positive in 1998. In 2002, she began a relationship with her now ex-husband. They were married in 2007. The husband learned she was HIV positive in 2009 and they divorced; he reported the crime in late 2010.

Darragh told AccessNorthGa.com that the ex-husband had taken an HIV test after learning of Nix's condition. "Fortunately, he was found to be HIV negative," Darragh said.
