Resident who kills man in driveway released from jail

LILBURN - The 69-year-old Gwinnett County man accused of fatally shooting a 22-year-old man who pulled into his driveway Saturday night has been released from jail.

Phillip Sailors was released from the Gwinnett County jail Wednesday afternoon on $10,000 bond.

An arrest warrant states Rodrigo Abad Diaz of Duluth was shot in the head as he tried to drive away from Sailors' home.

Sailors' attorney, Michael Puglise, has said Sailors assumed the young man was at his house for a home invasion robbery. Puglise says Sailors was defending his home and maintains his innocence.

Diaz' friends have said that the 22-year-old became confused over an address and pulled into Sailors' driveway accidentally.
