The state's high court, in a unanimous decision, denied the appeal of Marcin Waldemar Sosniak, who had claimed his constitutional right to a speedy trial had been violated. Sosniak is one of three men charged in the March 2006 shooting deaths at a house on Access Road in Forsyth County.
According to the court record, on March 19, 2006, the Forsyth County Sheriff's Office responded to a multiple shooting at a house on Access Road. Kyle Elliott Jones, Lynn Bartlett, Mariel Elisabeth Hannah and William Christopher Osment were found dead at the scene. Two others survived.
Sosniak, Jason McGhee and Frank Ortegon were arrested and on September 10, 2007, they were indicted for murder. On October 5, 2007, the District Attorney's Office announced it would seek the death penalty against all three.
Court documents indicated Sosniak's trial was originally scheduled for January 10, 2011, but at Sosniak's request the trial court continued the case until July 11, 2011. Sosniak filed a second motion for continuance, which the trial granted, and the case was continued until October 10, 2011. Sosniak filed a third motion for continuance on October 5, 2011, but the court denied it the following day. On October 7, 2011, Sosniak filed a motion to dismiss his charges alleging a constitutional speedy trial violation. On October 28, 2011, the trial court denied the motion. Sosniak then appealed to the state Supreme Court.
