Coke wins fountain soda fight

NEW YORK - A fight over fountain sodas has ended in Coca-Cola&#39;s favor after a federal appeals upheld an earlier dismissal of a rival&#39;s lawsuit. <br> <br> PepsiCo Incorporated had contended that Coke illegally controlled the market for fountain drinks by requiring soda distributors it dealt with to sell only Coke products to movie houses, restaurants and other retailers. <br> <br> A federal court threw out the 1998 lawsuit two years ago, saying that the independent distributors comprised a distribution channel rather than a market subject to federal business laws. <br> <br> The Second U.S. Circuit Court of Appeals in New York City upheld that decision in a ruling issued Tuesday. A Pepsi spokesman said yesterday that the company -- which is based in Purchase, New York -- would not appeal again. <br> <br> Pepsi spokesman Larry Jabbonsky says the company is disappointed with the ruling, while Coke spokesman Ben Deutsch says his company is pleased.
